Elder Law: What is it?

Unlike most areas of legal focus or specialty, Elder law is defined by the needs of the clients it serves.  Elder law arose from recognition that the senior members of our country had their own unique set of legal needs which often were interwoven.  This set of needs calls for attorneys who have taken the time to understand not only one piece of a legal puzzle, but the entire system of laws and programs which an elder citizen must navigate.  Some common examples include:
     
      • Wealth Transfer advice- Wills, Trusts, Gifts, Taxes, Letters of Administration…
      • Incapacitating conditions counseling – Powers of Attorney and Asset Control devices
      • Alternative decision making documents – Health Care Proxies, Living Wills
      • Probate – planning and management of estate administration
      • Long term care management – Navigating the system of varied care options for elder health issues
      • Medicaid planning – marshalling private and public resources to finance long term care/nursing homes
      • Enforcement of Elder rights – avoiding scams, nursing home abuse, fiduciary theft…

When you put these together, you have a set of needs which embodies what is today known as Elder Law.  It is our intent to be available to our elder clients to provide legal counsel regarding their goals for the management, administration and disposition of their accumulated estates, the proper implementation of surrogate decision-making powers, understanding and positioning themselves for long term care, addressing the tax consequences of planning decisions and knowing when more sophisticated tax advice is appropriate, and assisting elders and/or their families and representatives to assert their rights to full, fair, and proper treatment in diverse areas such as insurance, medical care, employment, investments and more.

As our nation enters a period where our elders are more numerous and living longer lives than ever in the history of the world, the legal profession is finally awakening to the unique needs of this group. We are proud to position ourselves as a law group which focuses on the needs of our Elders.
